CUSTOM CAKES BY GISELLE LLC Terms & Conditions Queens, NY / Effective Date: September 12, 2026/ Version 1.0

Welcome, and thank you so much for choosing Custom Cakes by Giselle LLC! Every cake we create is made with care, creativity, and a whole lot of love – and we want your experience to be just as sweet as the final product. These Terms & Conditions are here to make sure we’re on the same page from the very beginning, so there are no surprises for either of us. We’ve written them in plain English on purpose – we want you to read and understand them! By placing an order with us, you agree to the terms below. If you ever have a question about anything, please don’t hesitate to reach out. We’re always happy to talk things through.

1. Agreement & Acceptance • By placing an order, submitting a deposit, or signing an invoice with Custom Cakes by Giselle LLC, the client agrees to these Terms & Conditions in full – no exceptions. • Booking your order and paying the required retainer/deposit constitutes acceptance of this agreement and confirms your understanding of all policies outlined herein.

• These Terms apply to all orders, regardless of whether a separate written contract has been signed.

• If you are booking on behalf of another person or organization, you confirm that you have the authority to accept these Terms on their behalf.

2. Payment Terms • A non-refundable retainer deposit of 50% of the total order value is required at the time of booking to secure your date on our calendar. No date is held without a paid deposit.

• The remaining balance is due no later than 14 days before your event date. The exact due date will be confirmed on your invoice.

• Accepted payment methods include: Venmo, CashApp, Zelle, and Credit Card. All details will be provided at the time of invoicing.

• If the remaining balance is not received by the due date, Custom Cakes by Giselle LLC reserves the right to cancel the order, in which case the deposit is forfeited, and the date will be released.

• A late payment fee of $25 per day may be applied at Giselle’s discretion for balances not paid on time.

• All prices are quoted and payable in U.S. Dollars (USD).

• Quotes are valid for 10 calendar days from the date of issue. Prices are subject to change after that window.

3. Cancellation Policy

• Client – initiated cancellations: The deposit is non-refundable at all times, regardless of when the cancellation occurs. This covers time already invested in planning, sourcing, and scheduling.

• Cancellations within 14 days of the event date: If ingredients have been purchased or production has begun, the full remaining balance may also be forfeited. We will always be transparent about what stage your order is in.

• Cancellations more than 14 days begore the event: The remaining balance (beyond the deposit) will not be charged, provided production has not yet begun.

• Business-initiated cancellations: In the rare event that Custom Cakes by Giselle LLC must cancel due to an emergency, illness, or unforeseen circumstances, the client will receive a full refund, including the deposit. We will notify you as early as possible and do our best to recommend alternatives.

• All cancellations must be submitted in writing via email to [email protected] . Verbal cancellations will not be accepted or processed.

4. Refund & No-Refund Policy

• Custom cakes are made -to-order and perishable. Because each cake is crafted specifically for you, no refunds are issued once production has begun.

• If you believe there is a legitimate quality issue – meaning the cake is materially different from what was agreed upon in the order details – please contact Giselle immediately. She will work with you in good faith to find a resolution, which includes partial credit, correction, or replacement, at her sole discretion.

• The following situations do not qualify for refunds or credits: (a) Personal taste or flavor preferences after pickup/delivery (b) Minor color variations between the finished cake and digital mockups or inspiration photos (screen colors naturally differ from real-life frosting colors) (c) Normal handmade variation – each custom cake is a work of art, not a mass – produced item, and slight differences from a reference photo are expected and inherent to the craft. (d) Damage that occurs after the cake leaves Giselle’s care (see Section 9)

• Complaints and concerns must be raised within 24 hours of pickup or delivery and must be accompanied by a clear photographic documentation submitted via email.

A note from Giselle: Your happiness truly matters to us. If something isn’t right, please reach out right away – we would much rather work together to make it right than have you walk away disappointed.

5. Design Changes

• We love collaborating on your vision! Design changes and adjustments are welcome up to 14 days before your event date.

• Changes requested after the 14-day cutoff cannot be guaranteed and may incur additional fees depending on the scope of the change.

• Major redesigns (changing the style, tier count, or overall theme) within 14 days of the event are not possible, as production planning and ingredient sourcing will already be underway.

• Minor adjustments (such as color tweaks or inscription text) may be accommodated at Giselle’s discretion close to the event date. • All design changes must be confirmed in writing via email to be considered approved. Verbal or informal requests will not be acted upon.

6. Pickup-Only Policy for Tiered Cakes Important: All tiered (multi-tier) cakes are available for PICKUP ONLY. Giselle does not offer delivery for tiered cake orders under any circumstances.

• Tiered cakes are structurally complex and highly sensitive to movement, vibration, and temperature changes. For this reason, all multi-tier cake orders must be picked up directly from our location by the client or their authorized representative.

• At the time of pickup, Giselle will provide detailed verbal and written instructions for safe handling, transport, and storage of the cake.

• Once the cake is in the client’s possession, full responsibility for its care and transport transfers to the client (see also Section 9).

• Giselle is not liable for any damage, structural issues, or quality concerns that arise during or after client transport of a tiered cake.

• If you have questions about transport, we encourage you to ask at or before pickup – we’re always happy to help you prepare.

7. Delivery (Eligible Orders Only)

• Delivery is available for eligible orders (such as single-tier cakes, cupcakes, and dessert tables) within 10 miles of Cambria Heights NY. Tiered cakes are excluded from delivery (see Section6.)

• Delivery fees are determined by distance and order size and will be quoted at the time of your order. Delivery fees are non-refundable once delivery has been completed.

• Delivery times are estimated. While we always do our best to arrive as scheduled, slight delays may occur due to traffic, weather, or other circumstances outside of Giselle’s control. We will notify you as soon as possible of any expected delay.

• The client (or an authorized representative) must be available at the agreed delivery address and time window to receive the order. If no one is available at the time of delivery, a redelivery fee may apply, or the order may be considered fulfilled at the client’s expense.

• Delivery is to ground floor or easily accessible locations only. Giselle reserves the right to decline delivery to locations that pose a safety or accessibility risk.

8. Third – Party Courier Restrictions Please note: Custom Cakes by Giselle LLC does NOT authorize the use of third-party delivery services for any custom cake order, under any circumstances.

• The use of third – party courier services – including but not limited to DoorDash, Uber Eats, Instacart, Grubhub, Postmates, or similar platforms – to transport anu order from Custom Cakes by Giselle LLC is strictly prohibited.

• Custom cakes require specialized handling and careful transport. Third – party couriers are not trained or equipped to transport custom baked goods safely.

• Arranging a third – party courier to pick up your order voids all quality guarantees and damage liability protections. Giselle will not be responsible for any damage, loss, or quality issues arising from such delivery.

• If a third – party courier arrives at pickup on behalf of a client, Giselle reserves the right to refuse to release the order until the client or an authorized representative is present.

9. Transport Liability

• All liability for the cake is transferred to the client the moment it is picked up by the client or their authorized representative. Custom Cakes by Giselle LLC is not responsible for any damage that occurs after handoff.

• Giselle is not responsible for damage caused by improper vehicle setup (e.g., placing the cake on a seat rather than a flat surface), sudden stops or sharp turns, temperature exposure (e.g., a hot car), or mishandling after pickup.

• To protect both parties, Giselle will photograph the completed cake prior to pickup as documentation of its condition at the time of handoff. These photos may be used to assess any claims of damage or quality concerns submitted after pickup.

• We strongly recommend transporting cakes in a climate – controlled vehicle (air conditioning in summer, heat in winter), on a flat, non – slip surface such as the floor of the trunk or back seat. We will happily walk you through best practices at pickup.

10. Photo Documentation & Portfolio Use

• Custom Cakes by Giselle LLC reserves the right to photograph all completed cakes for internal documentation and business purposes prior to delivery or pickup.

• These photos may be shared on our social media accounts, website, and marketing materials (e.g., portfolio, promotional posts, advertisements) without additional notice to the client.

• If you prefer that your cake, not to be shared publicly, please notify Giselle in writing at the time of booking. We will fully respect your privacy and honor that request.

• We love it when clients share photos of their cakes! Clients’ tags, mentions, and posts on social media are always warmly welcomed – but never required.

• Client photos shared publicly become their own and are not subject to restrictions from Custom Cakes by Giselle LLC

11. Communication Expectations & Response Times

• Our preferred communication method is email at [email protected] . Phone calls are by appointment only.

• Giselle aims to respond to all inquiries and messages within 24 business hours. Monday through Friday. Weekend responses may take longer.

• Clients are expected to respond to requests for information, design approvals, and confirmations within 3 business days. Delays in client responses may result in delays to your order timeline, design confirmation, or delivery scheduling – and Custom Cakes by Giselle LLC will not be held responsible for any resulting issues.

• If a client is unreachable for more than 3 business days during the active production window, Giselle reserves the right to proceed with the agreed design or, in extreme cases, cancel the order with the deposit forfeited.

• For time-sensitive matters, please clearly mark your message with “URGENT” in the subject line or at the top of your message so it can be prioritized.

12. Client Responsibilities

• Clients are responsible for providing accurate and complete event details at the time of booking, including event date, event type, venue or delivery address, headcount/serving size, flavor selections, and design preferences.

• Clients must review and approve all order details – including the invoice, design summary, and flavor confirmation – prior to the production deadline. Orders will not enter production without confirmation.

• Any errors, omissions, or misunderstandings resulting from incorrect information provided by the client are the client’s responsibility. Changes made necessary by client error may incur additional fees.

• Clients are fully responsible for informing their guests of any known allergens present in the cake. While Giselle takes care in her kitchen, she works with common allergens including but not limited to wheat/gluten, eggs, dairy, nuts, and soy. Cross-contamination cannot be guaranteed against.

• Clients must ensure the designated pickup person (If not the client themselves) is aware of and prepared to follow all handling and transport instructions provided at pickup. Allergen Notice: Custom Cakes by Giselle LLC is not a certified allergen – free facility. Clients with severe allergies should consult with Giselle before placing an order. The version in effect at the time your order is placed is the version that governs your agreement with us.
